The "Eleventh" is approaching, and the implementation of the "Regulations on the Repair, Replacement, and Return of Household Car Products" (hereinafter referred to as the "Three Guarantees for Automobiles") has been implemented for nearly one year. However, from the data of the China Consumers Association, since the implementation of the “three-package method”, the number of complaints about auto consumption disputes has not decreased. Some experts believe that the increase in complaints about auto consumption disputes indicates that consumers' awareness of rights protection is getting stronger and stronger, which may not be a bad phenomenon. In addition, under the current automobile production and sales in China, the number of complaints for 12,643 in the first half of this year was only the tip of the iceberg.
From the data released by the China Consumers Association in the second issue of this year, in the first half of this year, consumer car consumption disputes continued to heat up, and the National Consumers Association organized 12,643 complaints about cars (including parts and components). Compared with the first half of 2013, the number of complaints increased by 29.2%, and the complaints about quality, contract and after-sales service accounted for more than 80%. After the official implementation of the “Three Guarantees for Automobiles” regulations, complaints about automotive products increased significantly.
There are four main types of complaints received by China Consumers Association. The first is quality problems: tires, rear axles, crankshaft breaks, and strange smells in new cars. For example, the FAW Volkswagen New Sagitar “Broken Axis” incident recently exposed, although the AQSIQ has initiated a defect investigation on the issue in mid-August, but FAW-Volkswagen has yet to give a clear answer.
The second is contract breach. Some unreasonable conditions for picking up cars such as price increase sales or additional decorations. The third is not fulfilling the "three guarantees" obligation. Mr. Peng, a consumer in Fuyang City, Hubei Province, complained that he purchased a family car on November 18, 2013. During the driving in March 2014, the engine crankshaft suddenly broke and the engine was seriously damaged. Mr. Peng found the merchant, requested to repair the vehicle, and bear the relevant repair costs. The sales merchants have given the concessions on the price of the "stock car", and do not give the consumer maintenance because they do not enjoy the "three guarantees" service.
The fourth is mandatory purchase of insurance, infringing consumers' choice of rights. On January 2, 2014, Mr. Zhang selected a new car at a car store. However, at the time of payment, the car store asks to buy a car insurance for an insurance company in the store for three years, otherwise it will not give the car. Mr. Zhang believes that the store's insurance price is relatively expensive. In order to be able to successfully pick up the car, he has agreed to buy it for one year, but the 4S shop still disagrees. Mr. Zhang had no choice but to complain to the Consumers Association. The staff of the Consumers Association believes that the dealer’s sale of tying insurance infringes on the consumer’s right to choose. After mediation, the dealer agrees that Mr. Zhang’s purchase of the car does not require insurance at the store.
Zhang Zhiyong, a well-known auto analyst, said in an interview with Zhongxin.com’s auto channel reporter that the increase in auto disputes indicates that consumers’ awareness of rights protection is getting stronger and stronger, which may not be a bad phenomenon. In China's huge auto consumer market, the number of complaints for 12,643 in the first half of this year is still far from enough. The number of complaints should be more reasonable. At the same time, the implementation of the “Three Guarantees for Automobiles” regulation has just been implemented for a year. There are still many areas that need to be improved. For example, the enforcement and authority of relevant law enforcement agencies are not enough, causing many manufacturers to ignore relevant laws and regulations, so the “Three Guarantees for Automobiles” regulations In the past year, more should be done to reflect.
